GENERAL
For the avoidance of misunderstanding we are required to outline our terms and conditions as these form the basis governing your use of the site and the purchase of goods from it. Information contained elsewhere on the site relating to ordering, answers to Frequently Asked Questions (FAQ’s), deliveries and returns form part of these terms and conditions. We would ask you to read these terms and conditions before doing anything other that browse as by using the site in any other way you signify your agreement to be bound by these terms and conditions and consent to us using any information you may provide us in accordance with our privacy policy.

You may only purchase items using a credit or debit card or other means of payment registered in your name and the first purchase that any new customer makes on the site using a credit or debit card will only be delivered to the registered address of the credit or debit card that was used for payment.

In these terms the words (or grammatical derivations thereof) ‘we’ ‘us’ ‘our’ or ‘Alistair R’ means Alistair R Limited; ‘purchaser’, ‘you’ ‘your’ ‘customer’ mean the person or persons ordering and paying for the goods.

CARE OF YOUR JEWELLERY
Your cufflinks have been designed to show the colour and tone of the natural material. The semi-precious stones or organic materials used vary in hardness and fragility but will give years of use provided they are handled with due care. If dropped on a hard surface, submitted to other such shock or exposed to corrosive chemicals or material they may be damaged or shatter and you may consider insuring against such risk as refunds or exchanges will not be given for any item that has suffered damage caused by accident or lack of care. If your cufflinks should become tarnished over time and you wish them cleaned we recommend you send them to a suitably qualified jewellery repairer. We do provide some tips on care maintenance of your jewellery – see the appropriate section on our site for details.

DESCRIPTION OF GOODS
We endeavor to select images for display on the site that are representative of the items being sold. However, as the semi-precious stones and shell products used are natural materials there will be variation in colour, tone or patterning and with few exceptions no two pairs of cufflinks or other jewellery of the same design/type will look the same. Each may vary slightly from the images supplied and acceptance of this by the customer is a condition of ordering.  Please also be aware that the quality of the images and colour rendition will vary depending on the hardware device being used to view them.

MULTIPLE ORDERS
The acceptance of multiple purchases is entirely at the discretion of Alistair R and in any event we will only supply multiple items (3 or more - any mix of type/design) to customers who have previously made purchases with Alistair R with which they were satisfied.

DELIVERY
Please see our ‘Delivery Information’ that forms part of these terms and conditions. Delivery times given are indicative only. We will not be held liable for late delivery of items and customers for whom timing of delivery is of the essence should following the instructions in the ‘Delivery Information’ elsewhere on this site.

We are unable to deliver to PO Box or BFPO addresses.

Title of the goods transfers to the purchaser once payment has been received and the goods have been signed for on delivery. The person ordering the goods is responsible for: 

  • the accuracy of the delivery address supplied,
  • being aware as part of these terms and conditions that anyone signing for the goods on receipt at the delivery address denotes receipt of them by the customer and for ensuring that someone is available to receive and sign for the goods. Where a customer has given instructions for the package to be left somewhere if they are not at home then the delivery of the goods as per their instructions denotes receipt of them by the customer. In the case of items being collected from a Post Office the requirements for ID in order to collect a package from the selected sorting office are as per those of the Post Office details of which can be found at http://www.postoffice.co.uk/mail/collection-services
  • the security of any arrangements regarding receipt of any delivery to your specified delivery address,

Except in the case of multiple orders (more than 2 items) our delivery packages will fit through a standard letter box.

Where the shipment has not been delivered due to an absence of a signatory at the destination address and the subsequent failure of the customer to collect the package from the nominated pick up location as advised or arranged then, upon receipt and subject to satisfactory inspection of any goods returned to us by the shipper, the cost of the returned items will be refunded to the customer less all costs of shipping and a reasonable handling charge.

INTERNATIONAL SHIPPING.   Postal services in the destination country may raise additional postage or delivery charges over and above and outside the knowledge and control of Alistair R and not included in the price of the goods and delivery service sold. It is a condition of placing an order with Alistair R that the purchaser accepts that any such charges raised in the destination country are their cost and it is their responsibility to settle them.

IMPORTATION, CUSTOMS AND DUTY (SHIPMENTS OUTSIDE THE EU).  It is a condition of placing an order with Alistair R that the person placing the order accepts full responsibility for:

a.  ensuring that the importation of the goods into the country to which they have ordered delivery does not contravene any form of trade restriction or embargo - either national or international.  

b.  paying any duty (customs or otherwise), taxes or administration charges raised in the destination country and for complying with any administrative requirements that may arise from the importation of the goods they have ordered.   

RECEIPT OF GOODS/GOODS DAMAGED IN TRANSIT
All goods are dispatched in secure packaging and are insured in transit. Title in the goods are deemed to have transferred to you when they are signed for or, in the case where special delivery instructions are given by the customer, when these have been completed. All deliveries require a signature and it is the purchasers responsibility to check for any any obvious signs of damage to the package that may have occurred in transit. You should note details of any such damage on the delivery docket, take photographs if appropriate and draw the delivery drivers attention to it as a claim may have to be made against the delivery company if on unpacking the goods you discover that they have been damaged in transit. If this has occurred you should contact us immediately using the ‘Contact us’ form on the website.

YOUR SATISFACTION
Our overriding wish is for you to be delighted with any purchase you make from us but if you should not be happy we have a returns procedure that you should follow in order to obtain a refund of the cost of the items or a replacement.

RETURNS
We naturally regret it if you are not entirely happy with your purchase but if this is the case you can return the item(s) within 28 days of purchase free of charge from anywhere in the UK subject to the following conditions/return procedure.

The items need to be returned in their original packaging complete with the dispatch note that accompanied them. On receipt and satisfactory inspection of the returned items we will be happy to refund the purchase amount to the account from which the original purchase was made. Please take the following steps: 

  1. Send an email to returns@alistairr.co.uk stating the original order number, your name, the item(s) being returned and the reason for the return.
  2. We use the Collect Plus network for returns and will email to you a returns label. Please print and attach it securely to the package being returned.
  3. Visit the website http://www.collectplus.co.uk/about-us and using the ‘Find a store’ search facility provided at the top of page locate the store most convenient to you.
  4. Take the package being returned to your chosen store and present it to the checkout. You will be given a receipt which includes a tracking number. You should keep this safely as proof that you have dispatched a package to us.

If you are wishing to exchange the item then your order will need to be refunded and a new order placed. Please email enquiries@alistairr.co.uk if you have any queries about this.

Non UK based customers. Unfortunately we are unable to offer free returns on any international orders and it is as a general condition of sale your responsibility to pay any delivery charges, duties and taxes incurred if you wish to return your purchase. In the event of your wishing to return an item then you should email us at returns@alistairr.co.uk prior to returning any goods – giving the information at ‘Refunds’ line 1 above.

Refunds. Please note that returned items will be checked and verified against any photographic dispatch records prior to any credit being raised.  In any event we aim to process refunds within 10 working days of receipt of the returned items.

Part Returns of Multiple Orders. In the case of part returns of multiple orders then any refund will be calculated on the basis of the value of the goods returned less the value of any discounts given with the original order that that were no longer applicable and, at the discretion of Alistair R, any non standard outward shipping costs (including insurance).

CANCELLING AND ORDER
We hope that you will not encounter circumstances which lead you to cancel your order but if you do wish to cancel then please contact us immediately as this gives us the best chance to halt the dispatch of the goods. Please be aware that it is a condition of your placing an order that you agree to return the goods as per the Returns Policy if you should cancel your order after the goods have been dispatched. Refunds are administered on receipt by us of the returned goods as per the Returns Policy.

DEFECTIVE OR DAMAGED ITEMS
All packages are dispatched by us clean and undamaged. If the package you receive is damaged in any way you should, before signing for it, carry out the actions included above in the section RECEIPT OF GOODS/GOODS DAMAGED IN TRANSIT as evidence will be required in the event of an insurance claim being made against the shipping company.

In the very unlikely event of you receiving an undamaged package where the contents are either defective, damaged or incorrect please contact us as soon as possible and return the goods within 28 days of receiving them as per the site’s returns procedure.  Subject to receipt of the returned goods and verification of your claim we will ask you choose whether you wish to receive a replacement item, exchange it for an alternative item or receive a refund.

The above applies to international customers to whom will, on verification of the claim, refund the price of the item in full, together with any applicable delivery charges, and any reasonable costs you incur in returning the item to us.

STANDARDS
All of our jewellery is hand made and finished in our workshop with components manufactured exclusively in workshops on the company’s premises and elsewhere in the UK, Germany and Ireland.  925 Sterling silver is used as standard and all items are hallmarked at the Birmingham Assay Office with our makers mark. Any components produced outside our workshops are done so to our own specifications and exclusive designs

WARRANTY
All our items are covered for a period of 12 months from the original date of purchase under the terms of this warranty. The warranty covers manufacturing defects only.

In order to make a claim under warranty you will need to return the items to us together with evidence of purchase. We recommend that you use a means of return that requires the parcel to be signed for on receipt as we cannot accept responsibility for items sent by you and lost in transit.

On receipt of the returned item we will inspect it and at our discretion and subject to it qualifying under the warranty terms decide either repair it free of charge or, if this is not possible. offer you an exchange or a refund.  A full or partial refund may be offered depending on the level of wear and tear.

CONTRACT FOR SALE
The description of the items and delivery (UK, Ireland) are set out on the order page. The advertising of items and services on this site is an 'invitation to treat'. That means your order is an offer and no contract of sale is formed between you and Alistair R until you receive the 'confirmation of order' email from us.  Orders shall be accepted at our sole discretion but are normally accepted once the order confirmation has been dispatched to you – at which point we will have checked that the order can be satisfied and that the prices are correct. Please keep your "confirmation of order" e-mail for your records.

In exceptional circumstances, if we are not able to fulfill an order we have accepted, your credit card will be re-credited with the original price and we will notify you by email. In no circumstances will we be liable to you for any additional amounts.

These terms and conditions cannot be varied except by changes made by Alistair R on the site, which we may make from time to time. Changes to these terms and conditions cannot be made retrospectively.  You will only own the items you purchase once they have been signed for on delivery or collected by you and when we have received cleared payment for them in full.  Until that time we will retain title to the items.  It is a strict condition of supply that any items sold are not offered for resale.

PAYMENT
Most well known credit and debit cards are accepted as well as Paypal. To provide additional security against card fraud we use Verified by Visa and Mastercard Securecode.

Alistair R use the services of a respected global payment services provider independent of us. They are experts in their field and use industry-standard encryption technologies when transferring and receiving customer data. Alistair R does not hold any of your financial information and will use the delivery address and contact information you supply solely for the purposes of fulfilling your order.

Please don't try to send orders via email, as we cannot guarantee secure transmission of details. We will take all reasonable care to keep your order secure, but in the absence of our sole negligence we cannot be held liable for any loss you may suffer if a third party obtains unauthorised access to any data supplied to our payment services provider when accessing or ordering from the site.  If you're still worried about security over the Internet, then please contact your bank for advice.

DISCLAIMER AND LIABILITY
We reserve the right to change, modify, substitute or remove without notice any information on the site from time to time.  We endeavour to ensure that all descriptions and illustrations of the items on the site are representative of the items being sold but there may be variations due to the lack of uniformity in the natural patterning and colouration of most semi precious stones. Different computer screens may also present colours in different ways. 

The site uses the Shopify platform and we strive to keep the site up to date. We are unable to guarantee that this site and its contents are completely free of technical errors, viruses or anything else that may have a harmful effect on any technology.  We will endeavour to allow uninterrupted access to the site but access may be suspended, restricted or terminated at any time.  By using this site, you acknowledge that you assume full responsibility for all costs associated with all necessary servicing or repairs of any equipment you use in connection with this site.

In no event shall we be liable for any indirect loss, consequential loss, loss of profit (whether direct or indirect), data, revenue, business opportunity, anticipated savings, goodwill or reputation whether in contract, tort or otherwise arising out of or in connection with the terms and conditions or use of the site save where such liability cannot be excluded by law.

To the maximum extent permitted by law, our liability to you in connection with any claim or series of connected claims under these terms and conditions shall not exceed £1,000 or the value of the items to which a claim is relevant, whichever is the lesser.

Notwithstanding anything else in these terms and conditions, we do not exclude or limit our liability in respect of death or personal injury caused by our negligence or for fraud or fraudulent misrepresentation.

These terms and conditions do not affect your legal rights as a consumer.

We shall not be liable to you or in breach of these terms and conditions for delay or failure to perform if the delay or failure is due to a cause beyond our reasonable control.

Alistair R cannot be held liable for any item that has been repaired or modified by a third party.

CUSTOMER RESPONSIBILITY
Alistair R cannot guarantee that the sale and delivery of its items to your particular country or location is permissible. It is the responsibility of the person or entity placing the order to be aware of and act in accordance with any import restrictions that may apply in the country to which the order is being delivered and to pay any import duties, taxes, administration, handling or other such additional fees in the destination country – such costs not having been included in the price of goods offered. Alistair R will not make any refund or reimbursements for any failure of delivery due to a customer’s failure in these respects – nor is it liable for the refund of any such costs in the event of goods being returned.

This site and its contents will not constitute the basis for any contractual commitment between Alistair R and any prospective customer in any jurisdiction in which the solicitation of interest or the offering of or sale of items by Alistair R would contravene any applicable local, regional or national legislation. No prospective customer should seek to make any order through the site from jurisdictions in which it would be illegal for Alistair R to sell items.

LEGAL GOVERNANCE
Your use of this site and any contract between you and Alistair R for the sale of items shall be governed by and construed in accordance with the laws of Northern Ireland and shall be subject to the non-exclusive jurisdiction of the Courts of Northern Ireland. If any provision of these terms and conditions shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these terms and conditions and shall not affect the validity or enforceability of any remaining provisions. If we fail to enforce a right under these terms and conditions, that failure will not prevent us from enforcing other rights, or the same type of right on a later occasion.

Unless otherwise stated in these terms and conditions, no part of these terms and conditions are enforceable by anyone who is not a party to them, pursuant to the Contracts (Rights of Third Parties) Act 1999.

All materials, including product images, illustrations, designs, site layout, product, written and other text or script that are part of this site are protected by copyright, trade mark, design right, and/or other intellectual property rights and are owned by or licenced to Alistair R.  Alistair R is a registered trademark.

PROTECTION OF CUSTOMERS DATA/PRIVACY POLICY
As part of normal accountancy practice and to facilitate smooth processing of returns the company will hold the names and email addresses of customers, the server protected by firewall and anti virus software. The company does not currently offer sales on the telephone so no customer credit card information is retained.

In signing up to follow Alistair R’s blog or newsletter or its Instagram or Facebook accounts customers are consenting to receive information from the company and for it, where applicable, to hold the contact information they supply. Such contact information will only be used for the purposes of supplying the service elected for by the customer. It will not be used for any other purpose nor knowingly shared with any third party. If a customer should wish to revoke any consent they may have given they should follow the steps to de-register (or cease to follow) given by Facebook, Instagram or on the blog page. If the customer has signed up to receive emails publicizing blog posts or newsletter features then they can cancel either by visiting the blog page and following the instructions to ‘unsubscribe’ or contact Alistair R at enquiries@alistairr.co.uk
